Abstract

The publication addresses match-fixing in sports based on bribery, a problem that is often ignored in politics and in legal literature. The author shows, that under the current German criminal code match-fixing cannot be sentenced, unless there is a sports bet involved. The author then discusses the few solutions to this problem that have been proposed in legal literature and shows the flaws of these proposals. He especially shows that match-fixing by way of bribery is fundamentally different from doping. Consequently. the author discusses how the current holes in the German criminal code can be filled by either adding a special paragraph against bribery in sports or by amending the existing Sec. 299 StGB. For both options the author discusses the pros and cons and ultimatively presents a specific wording for both options that could be used to sentence bribery in sports.
