Domestic violence (DV) possesses a complex background formed by persistent family issues, which results in numerous conflicts with various associated problems. A conflict regulation model such as TOA could contribute to solve these problems through a communication process amongst the parties involved. The history of the criminal law proved that the TOA, especially the TOA for DV, has been regarded as an ambiguous procedure and thus has been avoided for a long time. A meticulous investigation of this pioneering procedure could determine the possibilities and the limits of the TOA. This thesis thoroughly examines the TOA in DV, especially through a project from Hannover called HAIP – a rather new concept of TOA.
